Consumer Confidence Improves in August

Consumer sentiment improved slightly in August according to the latest Conference Board Consumer Confidence Index. The Index now stands at 56.9, up from 51.9 in July. The Present Situation Index decreased to 63.2 from 65.8 last month. The Expectations Index, however, increased to 52.8 from 42.7 in July.

Says Lynn Franco, Director of The Conference Board Consumer Research Center: "Consumer confidence readings suggest that the economy remains stuck in neutral, but may be showing signs of improvement by early next year. Declines in the Present Situation Index, both in terms of business conditions and the labor market, appear to be moderating. The Expectations Index, which posted a significant gain this month, suggests better times may be ahead. However, overall readings are still quite low by historical standards and it is still too early to tell if the worst is behind us."

Consumers' assessment of current conditions did not improve in August. Those claiming business conditions are "bad" increased to 33.2 percent from 32.6 percent, while those claiming business conditions are "good" edged up to 13.4 percent from 13.2 percent last month.

Consumers' appraisal of the labor market has turned bleaker. Those saying jobs are "hard to get" rose to 32.0 percent from 30.2 percent in July, while those claiming jobs are "plentiful" declined to 13.1percent from 13.6 percent.

Consumers' short-term expectations improved again, but still remain quite negative. Those expecting business conditions to worsen over the next six months declined to 25.8 percent from 32.4 percent, while those expecting conditions to improve rose to 11.9 percent from 9.2 percent. The outlook for the labor market was also less pessimistic. The percent of consumers anticipating fewer jobs in the months ahead decreased to 30.6 percent from 37.3 percent, while those expecting more jobs increased to 10.5 percent from 8.0 percent. The proportion of consumers anticipating their incomes will increase improved slightly to 14.7 percent from 14.3 percent.

HomeBuilderShowroom.com Sues Builders, Appliance Manufacturers Over Builder Homesite's ''Envision'' Feature

MARSHALL, TX –- www.HomeBuilderShowroom.com has filed a lawsuit against a group of homebuilders and home products manufacturers. The 72-page petition alleges the defendants committed trade secret theft, fraud, patent infringement and violated antitrust laws and confidentiality agreements in order to build its Builder Homesite website.

According to the lawsuit, HomeBuilderShowroom.com invented the "Builder's On-Line Assistant" in 1999. The revolutionary service was created as a means of using the Internet to connect homebuilders, manufacturers and homebuyers. The company's design allowed builders to offer standards and upgrades for homes as well as the opportunity for homebuyers to make their purchasing decisions online using virtual showrooms.

The owner of HomeBuilderShowroom.com – OLA, LLC, a privately held company based in Chicago – applied to patent the processes associated with "Builder's On-Line Assistant" in January 2000, and received two related patents in 2006 and 2007.

The lawsuit alleges that, prior to securing the patents, OLA reached confidentiality agreements with several of the defendants before providing a demonstration of "Builder's On-Line Assistant." Relying on the confidentiality agreements, the petition continues, OLA revealed details about its methods and service after receiving positive responses from several homebuilders and manufacturers.

However, according to the complaint, the defendants declined to purchase the service offered by OLA, and instead formed a new company that began marketing a nearly identical service in 2005 called "Envision."

The Austin, Texas-based company formed by the homebuilders and home products manufacturers – Builder Homesite Inc. – claims on its Web site that the "Envision" service has increased homebuilders' profits by $2,000 to $5,000 per home on more than 150,000 homes thus far. The same language is included on the Web site for New Home Technologies Inc., a Builder Homesite subsidiary.

Homebuilders named as defendants in the lawsuit include Beazer Homes, Centex, Weekley Homes, KB Home, Lennar, Pulte Homes, Standard Pacific and Toll Brothers.

Other defendents named in the suit include: Georgia-Pacific, Hearth & Home Technologies, Inc., Honeywell, Kohler, Masco Corporation, Therma-Tru Corp., Weyerhaeuser Company, Whirlpool Corporation and York International Corporation.

A copy of the lawsuit and more information about The Clearman Law Firm is available at www.clearmanlaw.com

National Home Price Index Shows 15.4% Decline in Second Quarter, But Possible Signs of Recovery

The latest Standard & Poor's S&P/Case-Shiller Home Price report reveals that home prices declined a record 15.4% in the second quarter of 2008 when compared to the same period a year earlier. The index's 10-city and 20-city composite indexes also showed broad declines, falling 17% and 15.9% respectively. The company noted however that the declines have slowed considerably since May, and that some markets may be starting to recover.

"While there is no national turnaround in residential real estate prices, it is possible that we are seeing some regions struggling to come back, which has resulted in some moderation in price declines at the national level" says David M. Blitzer, Chairman of the Index Committee at Standard & Poor's. "Depending on where you focus on the details of the report, you can see some different stories on where home prices are headed. Record year-over-year declines were reported in both the 10-City and 20-City Composites in June; however, they are very close to the values reported for May. The rate of home price decline may be slowing. For the month, the 10-City Composite was down 0.6% and the 20-City Composite was down 0.5%. While still falling, these are far less than the 2-2.5% monthly drops seen earlier in 2008. In June, nine of the 20 cities were up month-to-month compared with seven in May. Nevertheless, not one market is showing a positive return over the past 12 months and seven of the metro areas are reporting declines in excess of 20.0%."

At the national level, the housing market peaked around June/July of 2006. As of June 2008, two years later, the 10-City Composite has fallen by 20.3% and the 20-City Composite is down 18.8%. Las Vegas remains the weakest market, reporting an annual decline of 28.6%, followed by Miami and Phoenix at -28.3% and -27.9%, respectively. Phoenix was the worst performer for the June to May period, returning -2.6%. The markets that were the high-flyers during the recent real estate boom continue to be the ones that are leading the current decline. On the plus side, Denver and Boston were the best performing markets for the month, returning +1.5% and +1.2%, respectively. Both these markets have had three consecutive months of positive returns. They are outdone by Charlotte and Dallas, however, which have recorded four consecutive months of positive returns.

New-Home Sales Rise 2.4 Percent In July

WASHINGTON -- Sales of new single-family homes rose 2.4 percent to a seasonally adjusted annual rate of 515,000 units in July, the Commerce Department reported this week.

"While the improvement in new-home sales in July is definitely a favorable development, it comes on the heels of two consecutive months of significant downward revisions to sales numbers for May and June, so we have to keep the latest report in perspective," said NAHB Chief Economist David Seiders. "Nevertheless, we are cautiously optimistic that home sales are approaching a bottom, and that the newly enacted first-time home buyer tax credit (which went into effect as part of the housing stimulus bill on July 30) will help stimulate sales and provide crucial support for a market turnaround."

The median sales price of new houses sold in July 2008 was $230,700; the average sales price was $294,600. The seasonally adjusted estimate of new houses for sale at the end of July was 416,000. This represents a supply of 10.1 months at the current sales rate

On a regional basis, where estimates are subject to large month-to-month variations, sales activity was mixed in July. The Northeast posted a nearly 39 percent gain, the West posted a 9.9 percent gain, the Midwest posted an 8.2 percent decline and the South posted a 2.5 percent decline. Every region registered declines in the number of new homes for sale in July.

Ainsworth Announces Permanent Closure of OSB Mill in Minnesota

VANCOUVER, BRITISH COLUMBIA -- Ainsworth Lumber Co. Ltd. this week announced the permanent closure of the company's oriented strand board (OSB) mill located in Grand Rapids, Minnesota effective immediately.

The mill had not been in operation since September 2006.

"We made the very difficult decision to permanently close the facility following a strategic review of the mill's ability to be competitive both today and over the longer term", said Robert Allen, Chief Executive Officer. "Given a variety of factors including our business outlook, the structural challenges of operating in this region, and the condition of the mill at the time it was delivered to us by Potlatch, we simply cannot rationalize making the significant investment required to make the mill economically viable."

Ainsworth will work with the affected employees, governments and the union to mitigate the effect of this closure.

When operations were suspended in September 2006, the Grand Rapids operation employed approximately 190 people and had an annual production capacity of 390 million square feet (3/8" basis).

The Grand Rapids mill was built in 1980 and was acquired by Ainsworth in 2004 as part of the acquisition of Potlatch Corporation's OSB business.

Ainsworth will continue to have a significant presence in Minnesota, with OSB manufacturing facilities in Bemidji and Cook having a combined annual production capacity of approximately 800 million square feet (3/8" basis).

Consumer Reports Study Says Home Sellers Get More Money for Their Home When Selling without an Agent

Real estate website www.ForSaleByOwner.com is touting a new study conducted by Consumer Reports which found that home sellers who used a real estate agent received less money for their homes than sellers who sold their home without an agent. According to press release from ForSaleByOwner.com, the CR study found that homeowners who sold with the help of an agent received $5,000 less, on average, than the home's original asking price. Meanwhile, the study found that almost all people who sold without using an agent received what they originally asked. (The survey is published in the Consumer Reports September 2008 issue.)

"In today's market, where home prices are dropping, it's more important than ever for sellers to maximize their sales price," said Greg Healy, Vice President of Operations for ForSaleByOwner.com. "It's clear from this Consumer Reports research that sellers are better off using a 'for sale by owner' method to sell their homes. Not only will they get their asking price, they'll also avoid paying an expensive commission fee that would only lower the amount they actually receive for their home. For a $300,000 home, the $5,000 price differential and the commission paid to the agent represent a loss to a home seller of more than $20,000."

"Consumer Reports is a well respected publication and its research should help more people understand the financial advantages of selling their own home," added Healy.

The research from Consumer Reports is similar to findings of studies conducted by Northwestern University and Stanford University. Each of those studies found that "for sale by owner" sellers receive more money for their homes than those who use real estate agents to sell their homes.

Freud America, James Hardie Partner to Develop PCD-tipped HardieBlade That Generates Less Dust

HIGH POINT, NC -- Freud America, Inc., a premier manufacturer of superior cutting tools, has announced an exclusive partnership with industry leader James Hardie Building Products to bring the market an innovative blade with unprecedented cutting performance. The new Diablo HardieBlade™ saw blade, manufactured by Freud, is the only approved PCD-tipped circular saw blade approved by James Hardie Building Products. These industry-leading blades provide cleaner cuts, longer life, and less dust generation when cutting James Hardie® fiber cement products.

The new Diablo PCD HardieBlade saw blade series has a polycrystalline diamond (PCD) Triple Chip tooth design that reduces respirable dust generation by up to 50%* versus other PCD blades in independent laboratory testing. On average, the PCD blades last up to 60X longer than generic fiber cement carbide blades. During laboratory, field and in-house testing, the Diablo HardieBlade saw blades demonstrated truer cuts with greater resistance to abrasion. In addition, all Diablo HardieBlade saw blades have a super thin-kerf design which requires less cutting power, making them ideal for underpowered saws at the jobsite.

"We are excited about uniting with James Hardie to provide the contractor market with a superior blade," states Russell Kohl, President and CEO of Freud America, Inc. "Through our combination of unique blade features, this one-of-a-kind Diablo HardieBlade saw blade series will not only last longer than competitive blades but it also reduces the amount of respirable dust that is produced when cutting fiber cement products."

The Diablo HardieBlade saw blade line is available for 7-1/4" circular saws, 10" table or miter saws and 12" miter saws and includes other blade features such as:

--Laser Cut Stabilizer Vents eliminates sideways movement of the blade for a cleaner, quieter cut while reducing dust.

--Spark Eroded Triple Chip Tooth Geometry to dramatically increase the cutting life of the blade in all fiber cement products.

--Laser-Cut Blade enables the use of high strength steel with laser-cut heat expansion slots to allow the blade to expand due to heat build-up, thus keeping the cut true and straight while reducing premature wear.

--Perma-SHIELD™ Permanent Non-Stick Coating for protection against heat, rust, gumming and corrosion.

Diablo saw blades are available at independent hardware retailers and home centers. The Diablo PCD tipped HardieBlade can be identified by the green bar at the top of the packaging with the diamond icon. PCD saw blades are ideal for large projects and frequent, heavy-duty use in fiber cement products.

Survey Suggests Contractors More Loyal to Brand Than Dealers When Buying Wood Windows

A recent study was conducted by Minneapolis-based Market Resource Associates (MRA) with Home Builders and Remodeling Contractors to learn more about their purchasing habits for wood windows. The respondents were asked how they decide where to purchase their wood and wood clad windows--and how much of that decision is based on the brand of the window or the dealer selling the window.

Here is what 540 respondents said:

According to John Cashmore, President of MRA, "This is a trend we are seeing more and more, being caused by dealers' sales personnel not being trained properly, and able to answer some of the most basic questions about what they are selling. Many builders and remodelers are taking it upon themselves to understand a few important lines to their business, and don't rely on dealer personnel for anything beyond placing the order."

But is it all the dealers' fault? Not at all says Cashmore. "Dealers increasingly are trying to be all things to all people. They either stock or can order sometimes more than 10 brands of windows. This makes it difficult for their folks to gain a real understanding of so many brands, and leaves a huge product knowledge gap"

According to other studies conducted by the firm, similar answers have been found when MRA tests decking, siding, roofing, insulation, doors, power tools and many specialty forest products.

This represents a major shift over the past 10 years as local suppliers cease to exist or consolidate and "Joe" on the lumber counter retires and is not replaced.

Builder Confidence Virtually Unchanged in August, But Expectations Gauge Rises

WASHINGTON -- Anticipating positive impacts of newly enacted housing stimulus legislation, single-family home builders registered some improvement in their outlook for home sales in the next six months, according to the National Association of Home Builders/Wells Fargo Housing Market Index (HMI) for August, released today. The overall confidence measure held even this month at 16, while the component gauging sales expectations rose two points to 25.

"With the passage of crucial housing legislation last month that created an attractive home buyer tax credit, there is a sense that home sales may soon be reaching a turning point," noted NAHB President Sandy Dunn, a home builder from Point Pleasant, W.Va. "Builders are anticipating the stimulative effects of this legislation and are optimistic that the tax credit will give those buyers who've been sitting on the fence the reason they need to jump back into the market."

The Housing and Economic Recovery Act of 2008, signed into law by President Bush on July 30, implemented several critical reforms to the housing finance system, provided aid to troubled homeowners facing foreclosure, and created a temporary $7,500 tax credit for first-time home buyers who meet certain income requirements. NAHB has developed a Web site at www.federalhousingtaxcredit.com to promote the tax credit and answer commonly asked questions about it.

"While our overall measure of builder confidence remains at a record low at this time, it is a good sign that two out of three of the HMI's component indexes rose in August, and this may be an indication that we are nearing the bottom of the long downswing in new-home sales," said NAHB Chief Economist David Seiders. "Our current forecast shows stabilization of sales during the second half of this year, followed by solid recovery in 2009 and beyond."

Derived from a monthly survey that NAHB has been conducting for more than 20 years, the NAHB/Wells Fargo HMI gauges builder perceptions of current single-family home sales and sales expectations for the next six months as "good," "fair" or "poor." The survey also asks builders to rate traffic of prospective buyers as "high to very high," "average" or "low to very low." Scores for each component are then used to calculate a seasonally adjusted index where any number over 50 indicates that more builders view sales conditions as good than poor.

Two out of three of the HMI's component indexes posted gains in August, including a one-point rise in the index gauging current sales conditions, to 16, and a two-point uptick in the index gauging sales expectations for the next six months, to 25. The component gauging traffic of prospective buyers remained unchanged, at 12.

Regionally, the Northeast and Midwest each posted gains in builder confidence, with the Northeast up two points to 16 and the Midwest up four points to 14. Meanwhile, the South remained unchanged at 20, and the West, whose new-homes market has been heavily impacted by an upswing in foreclosure sales at cut-rate prices, posted a decline of three points to 11.

Construction Fatalities Declined in 2007

A total of 5,488 fatal work injuries across all industries were recorded in the United States in 2007, a decrease of 6 percent from 2006, according to preliminary figures released by the Bureau of Labor Statistics.

Fatalities also declined in the construction industry last year--falling to 1,178 from 1,239--but construction continued to incur the most fatalities of any industry in the private sector, as it has for the five years since the CFOI program began using the North American Industry Classification System (NAICS) to categorize industry.

Of the three major subsectors within construction, fatalities among workers in construction of buildings actually rose 11 percent from 2006, with most of the increase in non-residential construction industries. The largest construction subsector, specialty trade contractors, had 6 percent fewer fatalities in 2007 as compared to 2006.

The four occupations with the highest fatality rates were fishers and related fishing workers with a fatality rate of 111.8 per 100,000 workers, logging workers (86.4), aircraft pilots and flight engineers(66.7), and structural iron and steel workers (45.5).

Home Depot, Lowes Profits Fall on Economic Slump

ATLANTA -- The Home Depot said this week that second quarter earnings fell 25 percent to $1.2 billion, compared with $1.6 billion in the same period in fiscal 2007. Sales for the second quarter totaled $21.0 billion, a 5.4 percent decrease from the second quarter of fiscal 2007, reflecting negative comparable store sales of 7.9 percent, offset in part by sales from new stores.

"We continue to see pressure on our market and the consumer, generally," said Frank Blake, chairman & CEO. "Despite the macroeconomic conditions, we saw improved execution in our merchandising and operations initiatives during the past quarter. I am very proud of what our associates have accomplished in a difficult environment," said Blake.

Meanwhile, Lowes reported net earnings of $938 million for the quarter ended August 1, 2008, a 7.9 percent decline from the same period a year ago. Sales for the quarter increased 2.4 percent to $14.5 billion, up from $14.2 billion in the second quarter of 2007.

"Our sales results for the quarter, while better than our forecast, reflect the realities of the continuing macro economic pressures on our industry," commented Robert A. Niblock, Lowe's chairman and CEO. "We saw relative strength in our seasonal sales as homeowners welcomed back spring and restored lawns and outdoor landscaping following the effects of last year's drought in much of the country. In addition, we believe our second quarter sales benefited from the economic impact of the fiscal stimulus tax rebates. Unfortunately, weakness in bigger ticket projects continues, particularly in markets most impacted by the housing downturn."

Housing Starts Sink 11 Percent in July

Privately-owned housing starts in July were at a seasonally adjusted annual rate of 965,000, an 11 percent decline from June, the U.S. Department of Commerce said this week. Single family starts fared slightly better, falling just 2.9 percent from the previous month.

"The single-family numbers in this report are very much in sync with what home builders have been saying in our latest surveys," noted NAHB Chief Economist David Seiders. "While there is definitely a sense that we are nearing the bottom of the downswing in home sales, builders are not ready to start ratcheting up production just yet - nor should they be, until after sales begin to rebound and the inventory overhang is reduced further. We anticipate that the new first-time home buyer tax credit will help bring about that rebound, and NAHB's forecast projects that the ongoing contraction in housing starts will end in the first quarter of 2009."

Regionally, starts activity was somewhat mixed, with the Midwest posting a 10 percent gain and the South and West each posting 8.2 percent declines, while the Northeast posted a 30.4 percent decline - again due to the New York City numbers. Permit issuance was also mixed on a regional basis, with the Midwest posting a 1.4 percent gain, the South posting a 4.1 percent gain and the West registering a 14.8 percent decline. The Northeast's permits, also affected by New York City data, fell 63.4 percent.

BUILDING PERMITS
Privately-owned housing units authorized by building permits in July were at a seasonally adjusted annual rate of 937,000, 17.7 percent below the revised June rate of 1,138,000. Single-family authorizations in July were at a rate of 584,000, a 5.2 percent drop.

NAHB said the skid in both housing starts and permits were skewed by a building code change in New York City that caused an unusually large fluctuation in multifamily activity for the Northeast region.

BOSTON -- www.FreeGreen.com is giving away a custom green home design, valued at $25,000, while simultaneously helping to re-shape the American Home. This is all part of FreeGreen's unique business model and recently launched FreeGreen Challenge (FGC).

"The mission to make green home designs accessible to everyone has been the backbone of our company since its inception. The FGC is a natural extension of our company's goals, and perfectly timed with the new U.S. housing bill to encourage thought about energy efficieny and green features in new home builds," says company CEO, Dave Wax.

Through the FGC, users will be invited to tell FreeGreen about their upcoming home building project, and their ideas on the next evolution in green homes. The winner of the FGC will get to work with FreeGreen to turn their ideas into a fully customized and complete set of architectural plans. The company will keep track of the design and build process through updates on their blog, so that everyone can view, and learn from this unique process.

The final design will also be posted on www.FreeGreen.com where it, like all of the company's other designs, will be available free for download.

Chief Architectural Officer Ben Uyeda explains "Rather than prescriptively designing what we think the 'next' green home should be, we are going to ask consumers about their visions, dreams, and goals. It is this intersection of internet scale, and personal interaction which will allow us to develop new dwelling concepts that can be consumed by the masses."

The pioneer and leader in affordable green architecture, FreeGreen.com begins accepting challenge applications this week. The company's founders will pick the FreeGreen user which they believe presents the best, most practical, and most original green design ideas.

Indianapolis Once Again Nation's Most Affordable Housing Market

WASHINGTON -- Indianapolis, Indiana maintained its standing as the most affordable major U.S. housing market for the 12th consecutive time in the second quarter of 2008, according to the National Association of Home Builders/Wells Fargo Housing Opportunity Index (HOI) released recently.

Nationwide, homes became more affordable for the third consecutive quarter, with the HOI rising to and almost matching the highest level since the second quarter of 2004.

"Today's HOI reading shows that 55 percent of all new and existing homes that were sold during the second quarter were affordable to families earning the national median income of $61,500," said NAHB President Sandy Dunn, a builder from Point Pleasant, W.Va. "Several factors combined to increase housing affordability nationwide. There was a marginal rise in mortgage rates, which still remain near the historically low levels of a few years ago, family income nationwide held steady and lower house prices."

In the nation's most affordable major housing market of Indianapolis, 91.6 percent of homes sold in the second quarter were affordable to families earning the area's median household income of $65,100. Also near the top of the list for affordable major metros this time around were Youngstown-Warren-Boardman, Ohio-Pa.; Detroit-Livonia-Dearborn, Mich.; Warren-Troy-Farmington Hills, Mich.; and Grand Rapids-Wyoming, Mich., in that order.

One smaller metro market (fewer than 500,000 people) outranked all others in terms of housing affordability during the second quarter of 2008. This was Canton-Massillon, Ohio, where 96.7 percent of all homes sold in the period were affordable to families earning that area's median household income of $54,600.

New York-White Plains-Wayne, N.Y.-N.J. was the nation's least affordable major housing market. This was the first time a major housing market outside of California was designated the least affordable since the HOI's inception in 1991. In the New York market, 11.4 percent of new and existing homes sold during the second quarter were affordable to those earning the area's median family income of $63,000.

Other major metros at the bottom of the housing affordability chart included San Francisco-San Mateo-Redwood City, Calif.; Los Angeles-Long Beach-Glendale, Calif., Miami-Miami Beach- Kendall, Fla.; and Nassau-Suffolk, N.Y., in that order.

Among metro areas smaller than 500,000 people, the five markets at the bottom of the affordability chart were San Luis Obispo-Paso Robles, Calif.; Ocean City, N.J.; Napa, Calif.; Santa Cruz-Watsonville, Calif.; and Salinas, Calif., respectively.

Uponor Building New 285,000-square-foot Distribution Center in Minnesota

Uponor, a leader in PEX-a systems for radiant floor heating and cooling, plumbing and fire safety, recently broke ground for a new 285,000-square-foot distribution center, located in Lakeville, Minn., a suburb south of the Twin Cities.

The new building, which will house Uponor's primary North American distribution operations, is a build-to-suit facility leased from commercial building developer First Industrial Realty Trust, based in Chicago.

In accordance with Uponor's build-to-suit requirements, First Industrial is developing the building to apply for LEED(R) certification through innovative, energy-efficient designs. Specific areas of the building, primarily 13,000 square feet in the office area, will of course feature Uponor radiant floor heating and cooling as well as snow and ice melting in the sidewalks outside the office area.

"We want to make this a sustainable development," says Craig Patterson, senior development officer for First Industrial's Midwest region. "Incorporating Uponor's radiant technology in their new building helps us achieve this goal."

The new facility will be slightly larger than Uponor's current 271,000-square-foot distribution center located in Burnsville, Minn. However, the new facility will provide more storage space (about 30% more cubic volume) due to the higher interior clear height. The building will feature 25 dock doors along its east side, and its dimensions are designed to optimize Uponor's warehouse and distribution operations.

"This new facility provides several benefits for our operations from a logistical standpoint," says Dan Hughes, Uponor's real estate and development manager. "It is designed to be more operationally efficient and offers our employees, customers and business partners convenient access from freeways as well as our corporate headquarters in Apple Valley."

The facility's completion date is set for March 2009, with occupancy in early April.

TOANO, VA -- Lumber Liquidators, Inc., the largest specialty retailer of hardwood flooring in the U.S., said it more than doubled its net income during the second quarter to $5.9 million, on net sales of $128 million -- a sales increase of 21.1%.

Jeffrey W. Griffiths, President and Chief Executive Officer, commented, "We generated net income in the second quarter that was the best in our Company's history. We are very pleased to have achieved strong top- and bottom-line growth for the quarter and to have extended our positive momentum through the first half of 2008. We continued to experience increasing customer demand for our products and high acceptance for our appealing value proposition. In addition, improvements we have made in our merchandise assortment, in-stock positions and inventory allocation are reflected in our results. Overall, our performance to date this year reflects the increased discipline we have brought to our business as well as our entire team's ability to execute our business plan. Importantly, we are continuing to benefit from our recent operational improvements, which provide us with a solid foundation for long-term growth."

The company also increased its outlook for all of 2008. It now expects net sales to range from $480 million to $490 million compared to its previously expected range of $475 million to $490 million. However the company did scale back the number of stores it expects to open from, now expected to be from 33 to 38 stores.

Mr. Griffiths concluded, "We are encouraged by our strong performance in the first six months of 2008, especially given the challenging environment, and we are optimistic about our prospects for the second half of the year. Our new stores continue to perform ahead of our expectations and remain a significant contributor to our results. In addition, our stronger infrastructure is enabling us to create additional efficiencies while positioning our business for long-term effectiveness. We remain confident in our ability to execute our growth strategy focused on extending our footprint, growing sales and driving sustained operating margin expansion."

Remodeling Market Remained Sluggish In Second Quarter

WASHINGTON -- Residential Remodeling activity remained sluggish during the second quarter of 2008, according to the National Association of Home Builders' (NAHB) Remodeling Market Index (RMI). The current market conditions indicator rested at 41.8, the same level as the first quarter, while the future expectations measure rose slightly to 38 from 37.9 in the previous quarter.

The RMI measures remodeler perceptions of market demand for current and future residential remodeling projects. Any number over 50 indicates that the majority of remodelers view market conditions as improving. The RMI has been running below 50 since the final quarter of 2005, implying shrinkage of remodeling expenditures since that time.

"Remodelers are experiencing slower activity in markets nationwide, particularly for major improvements to owner-occupied housing" said NAHB Remodelers Chairman Lonny Rutherford, CGR, CAPS, CGP, a remodeler from Farmington, N. M. "While markets remain pretty active, most remodelers are taking on a greater number of smaller jobs to maintain their businesses."

The index shows a gradual decline in overall remodeling activity since 2005. Nationally, major additions and alterations declined slightly to 43.18 (from 44.15) during the second quarter, while minor additions and alterations increased slightly to 42.89 (from 41.57). Maintenance and repair declined to 39.06 (from 39.68).

"As in previous economic downturns, remodeling activity is proving to be cyclical rather than countercyclical, although the degree of decline pales in comparison to the setbacks registered in the new-home market, said NAHB Chief Economist David Seiders. "We expect remodeling to remain generally flat in 2009 followed by strong growth due to home maintenance needs."

Regionally, current market expectations dropped in the second quarter, with the Northeast falling to 32.8 (from 36.4), the South to 40.1 (from 42.2), and the West to 42.4 (from 42.9). The Midwest, however, increased to 52.9 (from 44.1). All measures for future expectation (calls for bids, amount of work committed for next three months and appointments for proposals) slumped slightly except for a small increase in backlog of remodeling jobs at 42.13 (from 41).

Eighty-four percent of surveyed remodelers also reported home builders diversifying into remodeling due to the downturn in home building, thus contributing to more saturated remodeling market conditions.

Trilogy By Shea Homes Teams With BP Solar To Offer Free Solar Power On New Homes

SCOTTSDALE, AZ -- Trilogy™ by Shea Homes, the first builder to roll out a national solar offering, has chosen to work with BP Solar, a global leader in solar energy. Trilogy will offer free solar power systems on new homes as part of its ongoing commitment to reducing the carbon footprint of homes in all of its Shea Homes Active Lifestyle(™ Communities across four states.

The BP Solar Home Solutions® systems are estimated to reduce the homes' electric bills by up to 60% per home, in addition to the approximately 30% energy usage reduction Trilogy homes already achieve with the Shea Green Certified™ standards for home building. Each home will be equipped with a 3-kilowatt solar power system, which helps provide security against electric rate increases, allowing consumers to hedge their future risks in the volatile energy markets.

"With the addition of solar in a home, we're no longer just efficient users of electricity, we become producers. Integrating a solar system into a home during construction is less expensive than adding it later, making solar more accessible and affordable than it's ever been," said Rick Andreen, president of Shea Homes' Active Lifestyle Communities. "Trilogy homes pass the true test of a 'green' home by integrating a mix of energy-saving and energy-generating devices that deliver immediate and long-term benefits for our customer."

Solar systems will be free through August 31st to new homebuyers in Trilogy communities in Arizona, California, Florida and Washington. After August 31st the systems will be available as an upgrade option. Homeowners will be able to track how much power their system is producing, along with its environmental benefits, via a Web-based remote monitoring system.

To maintain a consistent and visually appealing look for its high-end resort communities, Trilogy chose BP Solar's EnergyTile and Integra® systems. The EnergyTile roof-integrated solar electric system emulates the shape of common flat concrete tile roofs, making it one of the industry's most aesthetically pleasing solutions for tile roof applications. The Integra system offers a low-profile installation, enhancing the look on asphalt shingle roofs.

"We're proud to be Trilogy's exclusive solar provider as they become the first national residential builder to introduce solar across all of their communities," said Mary Shields, global vice president of marketing for BP Solar. "We are pleased to see that home builders around the country increasingly see the value that solar brings to their homes as well as to their homebuyers."

Trilogy communities are high-end resort communities offering a new choice in living to those looking for an exciting lifestyle that revolves around wellness, exploration, continued learning, and close personal connections. More information is available by visiting http://www.TrilogyLife.com or calling (800) 685-6494.

ATLANTA -- Beazer Homes USA, Inc. said it lost $109 million during its third quarter ended June 30, 2008. The company recorded revenues of $455.6 million, compared to $753.5 million in the third quarter of the prior year, but sales exceeeded what industry analysts were expecting.

"As our third quarter results illustrate, difficult operating conditions in the homebuilding industry persist," said Ian J. McCarthy, President and Chief Executive Officer. "Despite lower home prices, relatively low interest rates and a large choice of available homes, potential homebuyers remain reluctant due to eroding consumer confidence amid concerns about employment growth, higher energy costs and the overall economy. Based on these demand dynamics, coupled with high supply levels of new and existing home inventory, we believe industry conditions will remain challenging for the remainder of this fiscal year and as we enter fiscal 2009."

The Company had a cash balance of $314.2 million, an increase from $273.7 million as of March 31, 2008.

During the quarter, the company closed 1,677 homes, compared to 2,659 in the third quarter of the prior year. The average sales price was $257,400 compared to $282,100 in the third quarter of the prior year.

"The initial response is encouraging," said NAHB President Sandy Dunn, a home builder from Point Pleasant, W.Va. "This could be the trigger that helps move prospective first-time buyers off the fence and back into the market. But it won't last forever."

The tax credit is among several provisions included in landmark housing legislation enacted into law last month that will help get housing and the economy back on their feet.

The Web site contains useful information on how the tax credit works, including eligibility requirements. To date, the site has attracted 116,000 unique visitors, or about 10,000 per day. It includes details and questions and answers on how home buyers can use the credit and is divided into four sections:

- Tax Credit at a Glance. This provides a brief overview on how the credit works.

- Frequently Asked Questions. A clear to read question and answer format contains basic information about the tax credit, including the definition of a first-time home buyer, what type of homes qualify for the tax credit, what are the income limits to qualify, payback provisions and more.

- The Law's Other Provisions. In addition to the tax credit, this section summarizes a number of provisions in the Housing and Economic Recovery Act of 2008 that will help prevent foreclosures, reinvigorate the housing market and strengthen the nation's economy.

- Home Buyer Resources. Provides online resources to make the buying process smoother.

J.D. Power and Associates Survey Finds Among Consumers, Pella Ranks Highest in Satisfaction With Windows and Patio Doors

WESTLAKE VILLAGE, CA -- Pella ranks highest in satisfying consumers with windows and patio doors for a second consecutive year, according to the J.D. Power and Associates 2008 Windows and Patio Doors Satisfaction Study(SM) released last week.

The study, now in its second year, measures satisfaction among consumers who purchased new windows or patio doors. Overall satisfaction is based on performance in seven factors (in order of importance): ordering and delivery (22%); value (21%); operational performance (15%); product quality/durability (14%); appearance and design features (12%); repair and replacement (10%); and warranty (8%). Respondents may have installed the windows or patio doors themselves or with help from family and friends; hired an independent contractor, handyman or remodeler; used an installation service provided by a home improvement retailer; or used an installation service provided by the product manufacturer.

Pella achieves a score of 794 on a 1,000-point scale and performs particularly well in five of the seven factors: operational performance; product quality/durability; appearance and design features; warranty; and ordering and delivery. Marvin closely follows Pella in the rankings with a score of 792, performing well in the value and ordering and delivery factors. In addition, Marvin posts the greatest improvement in rank position since 2007 of any manufacturer included in the study. Andersen ranks third with an index score of 790, performing particularly well in the warranty and repair and replacement factors.

The study finds that a relatively small percentage of consumers -- approximately one in ten -- report experiencing a problem with their windows or patio doors. Among those customers who report a problem, failure of the window or patio door to close or lock properly is the most frequently cited issue, mentioned by one in five consumers who report a problem.

"With overall satisfaction remaining stable since 2007, it is apparent that window and patio door manufacturers are continuing to doing a good job of pleasing their customers, which is no small feat in these tight economic times," said Jim Howland, senior director in the real estate industries practice at J.D. Power and Associates. "In this highly competitive industry, those manufacturers that provide products with superior quality -- including a particularly low incidence of problems -- and that also communicate the value of their products and services to the consumer will be in the best position to differentiate themselves from the competition."

The study also finds that consumers who install their new windows and patio doors themselves are just as satisfied with the experience, on average, as consumers who use an installation service, handyman or independent contractor.

"Given that proper installation is critical to good window performance, it may seem counterintuitive that customer satisfaction with self-installed windows is commensurate to that of customers with windows installed by a contractor or handyman, but study data shows that this is indeed the case," said Howland. "For those consumers who are considering performing installation themselves, they should make sure they are comfortable with the particulars of the project, including the exterior siding material of the home; scope of the job -- including the number and sizes of windows required; whether windows will be retro-fitted or replaced; local code requirements; whether any special tools are required; and their personal skill level. Consumers may wish to turn to manufacturer web sites for help, since they often provide detailed product installation information."

The 2008 Windows and Patio Doors Satisfaction Study is based on responses from 2,433 consumers who purchased new windows or patio doors in the previous 12 months. The study was fielded in March and April 2008.

LP Warns Some of its Composite Decking Poses Injury Risk Due to Deterioration

NASHVILLE, TN -- Louisiana-Pacific Corporation (LP Building Products) has issued a product advisory for composite decking materials purchased after January 1, 2005, and made by LP at its Meridian, Idaho facility.

Some of the product can prematurely deteriorate and break, posing a risk of injury to consumers. LP decking products, including deck board and railings sold under the names of LP WeatherBest®, WeatherBest®, ABTCo and Veranda® are subject to this advisory.

The products are used for building outdoor decks. LP has received claims of premature deterioration of a small portion of its decking product due to variations in manufacturing processes in this time frame.

LP Executive Vice President of Specialty Products and Sales Rick Olszewski said, "We want consumers to be aware of the potential risk of injury, and to contact us. Though only a small portion of decking sold has been affected by these issues, we urge people who bought or installed these composite decking products after January 1, 2005 to contact us for an inspection through our decking notice Web site or customer service line."

The decking advisory Web site is at www.deckingnotice.com

Products Affected
WeatherBest, ABTCo and Veranda are composite products that look similar to natural wood and are sold in several different colors, including Driftwood Grey, Pacific Cedar, Tuscan Walnut, Western Redwood, Chestnut and Greystone.

The affected products were sold after January 1, 2005 under the WeatherBest name at building products dealers nationwide, and under the Veranda and ABTCo brands at The Home Depot stores in the western part of the U.S.

Only those Veranda decking and railing products manufactured by LP are the subject of this advisory. WeatherBest products manufactured after LP's sale of the Meridian plant in October 2007 are not affected.

Consumers should check their Veranda, WeatherBest or ABTCo decking materials for visible cracks or deterioration on the surface, and/or chipping of the surface layers. If the deck or railing is deteriorating, do not use the deck. Contact LP Decking Customer Service to promptly arrange for an inspection of the deck.

Even if there is no visible sign of deterioration, if you purchased Veranda or WeatherBest decking or railing products after January 1, 2005, please visit the decking advisory Web site at www.deckingnotice.com or contact LP Decking Customer Service to register and determine if your deck is among the products affected.

Veranda is produced by several manufacturers, but only product produced by LP is affected by this advisory. Visit www.deckingnotice.com or contact LP Decking Customer Service for help in determining which product you may have.

To ensure deck owners' safety, LP will arrange an inspection to determine if your deck is affected by the deterioration issue in this notice and will remedy the problem, up to replacement of the entire deck if needed.

For more information, help identifying the products or to arrange an inspection, go to LP's decking advisory Web site at www.deckingnotice.com or contact LP Decking Customer Service at 1.888.325.1184.

WESTLAKE VILLAGE, CA -- Online real estate search company Move, Inc. said it lost $2.2 million during its second quarter, on sales of $61.4 million. The company also announced that it has engaged an investment banker to assist in the sale of its Welcome Wagon business. It also announced that it would make significant reductions in its operating expenses.

"The decision to sell Welcome Wagon was not made lightly," said Move Inc. President Lorna M. Borenstein during a teleconference to discuss the company's earnings. "However, we know that we have to not only be willing, but decisive, about shifting or eliminating resources if they cannot contribute to the overall growth of the business. The same is true of our planned expense reductions."

Despite the loss, the company said its Realtor.com website Realtor.com achieved its highest June and July sales in history.

"The issues and challenges facing the residential real estate market are creating a permanent dislocation in the offline real estate advertising market with online spending benefiting in the long run," said Mike Long, Move's CEO. "As the market recovers, the needs of consumers and advertisers will be quite different than they are today. We have a clear strategy to meet those needs and are adjusting our business to focus on assets and new development initiatives that are essential to our long term strategy while eliminating unprofitable revenue streams and improving cash flow to invest in growth. Our success has been, and will continue to be, driven by our clear market leadership, as consumers have shown through their actions that Move is the most trusted source in online real estate."

Reed Construction Data Releases ''Green Home Improvement'' Book

KINGSTON, MA -- RSMeans, a business unit of Reed Construction Data, announces a new book, "Green Home Improvement," which includes 65 full-color projects that fight back against skyrocketing utility costs, health concerns, and environmental damage. Objective, expert advice cuts through the "green-washing" to the best products and improvements. Unique to this book are costs and estimated energy savings to help homeowners decide where to invest.

Many projects are easy and low-cost (often less than $5), with a big impact. Efficient showerheads, for instance, can pay for themselves 10-20 times over in the first year alone! Adding insulation and a programmable thermostat could cut energy costs by 50% in some homes. Green improvements also bring higher prices and more buyers when selling a home.

Features:
--65 projects -- flooring, paint, cabinetry/countertops, windows, doors, insulation/weatherstripping, roofing, siding, heating and cooling, lighting, appliances, bath fixtures, solar systems, paving, pools, and landscaping.

--100+ "Go Green" tips – instant, low- or no-cost ways to save energy and water and make homes healthier/more comfortable.

--Advice for building a new home – points to discuss with a builder or architect.

Michael Berry, Chair of the National Association of Home Builders Boston chapter's Sustainable Building Committee, says, "This book will help homeowners green their homes cost-effectively -- saving energy and becoming better stewards of the environment."

About the Author
Dan Chiras, PhD, is a well-known green building expert who advises homeowners, architects, builders, and developers throughout the U.S. and Canada. He has published 24 books and hundreds of articles, and presented lectures and workshops to universities, the general public, and organizations including the U.S. Green Building Council and American Institute of Architects. Dan was recently filmed for a Discovery Channel "Planet Green" series, executive-produced by Leonardo Di Caprio. Dan designed his own green home, featured on NBC's "Nightly News."

LATHAM, NY and SPRINGFIELD, MA -- Spruce Computer Systems and Solutions by Computer have partnered to integrate the Enfinity® rental application with the SpruceWare.NET business and information management system. The integration is seen as a no-compromise alternative for lumber, hardware or building material dealers seeking the most modern software both for the multifaceted needs of their retail businesses and for the unique needs of their rental departments.

Integration Solves a Common Challenge
"SpruceWare.NET users are already familiar with the benefits of the most modern yet easy to use Windows-based software available for their businesses," said Rob Fitzpatrick, President of Spruce Computer Systems. "Up until now, though, their rental departments have had to compromise in order to get receivables, sales tax and general ledger to balance between the rental departments and stores. Integrating Enfinity into SpruceWare.NET solves that problem."

Both SpruceWare.NET and Enfinity were written from the ground up as true Windows software packages, and the simple integration between the two allows rental transactions and purchases to be combined on the same ticket. Sales tax and receivables are handled by the SpruceWare.NET system for easy tracking and reconciliation, and the rental activities are tracked and processed using the full functionality of the Enfinity rental management system.

Since all Tile Redi shower pans allow ceramic, glass or stone tiles to be adhered directly to the surface, each drain is manufactured in a square form, rather than a circle, to make the drain easier to tile around. The designer drain plates are available in 18 variations of the standard base colors, including Black, Brass, Bronze, Chrome, Copper, Nickel and White, in order to match the existing hardware in the bathroom.

Tile Redi's unique line of products have set a new industry standard for labor- and time-reducing shower installations.
BMHC Discontinues All SelectBuild Florida Operations

SAN FRANCISCO, CA -- Building Materials Holding Corporation, a leading provider of building materials and construction services to professional residential builders and contractors, announced it will discontinue operations at its wholly-owned subsidiary SelectBuild Florida over the next four months.

"In light of the challenging homebuilding environment, we recognize the need to realign our business across the country to reflect local conditions," said Stanley M. Wilson, President and Chief Operating Officer. "The closure of the SelectBuild Florida facilities is in direct response to the challenging business environment in Florida. The Florida market has weakened considerably and we anticipate it will be some time before improvement is seen. Housing starts in the Florida market have dropped from a peak of 265,000 in 2005 to only 99,000 in 2007 and an estimated 61,000 in 2008."

This action affects approximately 140 employees at SelectBuild Florida's shell, truss and stair operations throughout the state. SelectBuild intends to complete all construction in progress and fulfill all outstanding contractual obligations during a four month wind-down period.

"We thank all the employees of SelectBuild Florida for their long record of hard work and commitment to the Company. Today's announcement is by no means a reflection on the performance of our workforce; rather it is an unfortunate result of the current condition of Florida's construction marketplace," added Mr. Wilson.

Taylor Morrison Relocates Headquarters from Florida to Arizona

SCOTTSDALE, AZ -- Homebuilder Taylor Morrison has shifted its North American headquarters westward, moving its base of operations from Florida to Arizona.

The homebuilder relocated its corporate offices to Scottsdale, Ariz., at the end of July to better align the company's headquarters with its strongest home building markets, said Taylor Morrison President and Chief Executive Officer Sheryl Palmer.

"We see our relocation to Arizona as being beneficial for Taylor Morrison as a whole," Palmer said. "Our biggest markets are located in the western United States and they will provide significant growth for the company in years to come."

Taylor Morrison currently operates more than 200 communities across the United States. The company also operates in Canada as the Monarch Corporation.

The new Scottsdale location allows for convenient access to the company's Texas, Colorado, Nevada, California and Arizona communities, Palmer said. Florida, where the company had been based since its July 2007 merger, remains a key market and an integral piece of the company's future growth, she said.

WCI Communities Files for Chapter 11 Bankruptcy

BONITA SPRINGS, FL -- WCI Communities, Inc., a developer, builder and seller of luxury homes and tower units, announced this week that it and approximately 130 of its wholly-owned subsidiaries had filed voluntary petitions to restructure their debt and capital. Excluded from the filing is the company's Watermark real estate brokerage, which does business as Prudential Florida WCI Realty, as well as its WCI Mortgage business and certain other joint ventures in which WCI is a partner.

Carl C. Icahn, chairman of WCI's Board of Directors said, "The company, with all diligence, has attempted to avoid a bankruptcy filing. However, the filing became necessary because of the recent failed effort to obtain financing and the recognition that the company's entire $1.8 billion of debt may soon be in default."

WCI also announced that it and Jerry L. Starkey, who served as WCI's chief executive officer since 2005, mutually determined that, with the company going in a new direction and operating in bankruptcy, it is time for new leadership at the CEO level. Accordingly, Mr. Starkey will leave the company effective immediately.

David L. Fry, 48, has been appointed by the Board to act as interim president and chief executive officer, pending the selection of a permanent CEO. The Board intends to commence its search for a new chief executive officer and president immediately. Mr. Fry joined WCI in 1995 and was appointed as chief operating officer in November 2007. In addition to his new responsibilities, Mr. Fry will continue to be responsible for WCI's operations nationwide.

"Day-to-day operations will continue as usual, while we work with our stakeholders to restructure the balance sheet," said Fry. "We will continue to sell, build and deliver homes without interruption. Construction and sales activities will continue; employees will come to work and be paid."

Mr. Fry said that recreational amenities and services at each of the company's clubs and community associations will also continue, adding that the company has requested Court permission to continue to pay the full amount of its dues and deficit obligations to its various community associations and clubs.

Prudential Florida WCI Realty will continue to provide a full menu of real estate services, including new home and resale brokerage services, as well as foreclosure and rental management services. The company said realtors, brokers and customers will see no interruption in these services. All commissions and other obligations will be honored and paid. WCI Mortgage, an affiliate of Well Fargo Home Mortgage, will continue to offer competitive mortgage packages and will honor all of its existing obligations.

WCI Communities has established a toll-free information line for vendors, customers and other interested parties. The number is 800-924-1890. Information is also available at wcicommunities.com
